Employers are required to manage risks under section 2(1) of the Health and Safety at Work. Regulation 3 of the Management of Health and Safety at Work Regulations 1999 requires employers to make ‘suitable and sufficient assessment’ of the risks to the health and safety of his employees to which they are exposed whilst they are at work. Fortunately, the law recognises that employers can either be good at running a company or having a go at becoming a health and safety expert.... This is why the law allows for an employer to appoint a ‘competent person’ to assist them to meet their legal obligations. The Management of Health and Safety at Work Regulations 1999. Regulation 3, says that every employer shall make suitable and sufficient Risk Assessments of the risks to the health and safety of his employees to which they are exposed whilst they are at work. Regulation 7, says that every employer is required under law to appoint a Competent Person to assist them meet their legal health and safety obligations. An employer who has not made an appointment of a suitable person to fulfil the competent person role is in breach of a statutory duty. THE MAGISTRATES COURT: Powers to impose maximum fines of up to 5000 pounds for each offence under Health and Safety legislation, and or up to 6 months imprisonment. More serious offences under the Health and Safety at Work Act 1974 (sections 2-6), Food Safety Act, and Environmental Act 1991, attract a 20, 000 pounds penalty. CROWN COURT: Indictable cases and those elected to be tried by jury from a magistrates court are heard by a Judge. The court has powers to impose unlimited fines and or a maximum of 2 years imprisonment for offences related to Health and Safety at Work.
