Recovering costs from a client

I am being given prices up to £50,000 to pursue a claim of some £20,000 with no guarrantee of success or recovering my costs. This is unacceptable and seems totally unreasonable.

I am informed I may be able to find a solicitor prepared to defer payment or even an ATE scheme that would be suitable, but it seems all the no win no fee schemes are for simple accident claims.

I hope you can help me with advice as I fear the present situation may close my company. I have a very well recorded and strong case but the client has taken a decision just to end our contract by stopping access to the site.

Have you considered either commercial mediation or arbitration on this issue? Commercial litigation is considered high risk and unless you have contract insurance in place before the problem occurs becomes a commercial nonsense. Have you also considered running a commercial credit rating on the other party in this? It may be that will assist you in making a decision to proceed, if there is no the ability to pay then it can be hugely wasted effort. We have access to ATE policies similar to that you would buy after an accident for a no win no fee claim, which do cover litigation, also when we take a case we give the client an option of paying a retainer per month, like £200 to cover court fees on issuing the claim etc, that way we can hold the balance on account against our fees too, please call us to discuss your case we can make an appointment for a free 30 minute consultation by telephone 01482 325863
