Office burgled by minors who will only get a warning

Hi wondered if anybody could help me, i have had my office burgled by a 14 year old and 16 year old, they are only going to get a final warning at the most even thought they stole around £3000.

I would like to inform the local community of their activities, am I within the law to publicise this, ie send flyers to the local homes businesses naming the individuals, they have admitted the crime and were charged but will not go to court as their first offence, but sure it will not be their last.

I feel people should know what they have done as they seem to have got away with it, the money has not been recovered as they have just lied to the police and their parents who do not think it is necessary to reimburse me for their children's crimes.

Children and Young Persons Act 1933 protects children under the age of 18 from being named and shamed to prevent their future life being blighted by a crime that they committed as a child.

You would need to show a significant risk to public safety, to justify naming and shaming children.

Jamie Bulger's killers were named but their identities have been protected ever since. There is a significant risk to their person should their identities be discovered, such is the enduring horror of their crime.

The children in your case are just 14 and 16. They might go on to a life of crime, they might not. Naming and shaming them may push them in the wrong direction. That's why there is a law to protect them.

I understand your feelings but have a question for you? the law is fairly tuff these days theft is theft if they have been charged what makes you think they won't go to court? has the crown decided not to Prosecute them

if the police have charged them then a court hearing is inevitable is it not..?

Hi no they will not go to court they are to just get a warning and told off! and that is it for the British justice system, their parents are not made to pay anything back and they are not being made to do anything either. To not let people aware of what they have done and should not be able to just carry on and do this to somebody else. They will steal again. They stole thousands of pounds. They are not going to even be sent to a juvenile centre to be counselled for what they have done, not going to make a difference but they should have some accountability or inconvenience in their lives.

it seems then the police don't have enough evidence then to prosecute them to gain a conviction the court has to have proof of beyond reasonable doubt unless they caught them in the act or have cctv footage of them carrying out the theft not much they can do really apart from caution them

i know its frustrating for you but if i were you i would put it behind you

if you it make it known to the general public and name these kids you would be breaking the law! and there would be evidence too! its not worth the agro it will bring to your door

My advise is to beef up your security or get a night watchman to stop any re-peat of this happening again it is very frustrating when this happens but to be honest a rotten sign of the times

No they have admitted the robbery and have been charged but it is british law, because they are young and their first offence they do not get anything done to them. I think perhaps the short sharp shock is what they need.  Well I have just got half back from one of the parents today so that is something so somebody has a conscience. Don't think the other one will step up though.

well if they have admitted the guilt of stealing your cash and one has paid it back its not all bad

the other defendant ( for want of a better word).... could i think i am right in saying be brought before the courts if you take out a private prosecution through the small claims court ? you would need to speak to a solicitor

you may find the family are poor and can't repay it but i am sure if it went in your favour some sort of award would be coming your way even a small percentage of what they stole plus costs at £10.00 a week

would mean you have some satisfaction they did not get away with it !

Well worth a thought but I don't think that parents take any responsibility by law for their kids, they just get locked up for not sending them to school but not accountable for other crimes, I think they should have to take out 3rd party insurance lilke i do for my dogs and horses! Thanks for your comments anyway.

Hi you can make an application to the the small claims court online for a small fee depending on how busy they are it only takes about 4-5 weeks for them to issue a summons

you will need to include any correspondence from the police to back up your claim from the information you say you have it sounds like to me you would have a good chance of a settlement

Please come back and let us know how you got on i for one would like to know the result i spend a fair bit of time on the forums offering a little moral support and a view from outside the box! it would be nice to know that i am not wasting my time
