hi guysi recently won a quote for a garden wall re build. job is absolutely spot on. i am owed £'s, enough to support a weeks wage. i would like to report her somehow on here and anywhere else you think? she has had the spare materials removed which i was going to take back to my suppliers. she is responding to the odd text saying i will be paid once removed the rubbish which she has left after having the materials removed! i have been robbed. i did the job cheaply to get in, with the promise of more work. as you can imagine i am fuming.

No benefit reporting her on here I wouldnt think, unless you think it will protect others?Take her to a small claims court - see if that speeds up her payment!

You could always go round and start taking the wall down again...

That might make her keener to pay.

We had a problem with a pub a while back, our engineers completed the system, obtained the sat note from the customer, no payment...... we called, and visited the site but the staff always insisted the owner was not available, then me and my business partner turned up and started taking the CCTV system out, within 30 minutes of us being there they sent the cash down....

I,m afraid this seems to be happening more and more to tradesmen including myself .

As you say they got you to give a cheep quote with the promise of more work if you did a good job on the wall. Even though the work was spot on there are so called customers that are looking to either get the job done for half the cost of which you quote them i.e. give some payment along the way to keep the trust that they will pay in the end but never intend too.

I looked for a way to report the clients who did the same to me on here but i could not find a way to either on here or any other site. I think there should be a site called rouge customers where tradesmen can report these people so no one else gets stung by them.

As jacqueline suggested you could go back and remove some of the wall to see if they may pay up then but be careful as posesion is 9 tenths of the law but if go on the request of the customers to remove the rubbish and notice that your not happy with some of the brickwork so you removed it! and then suggest that you will return to reinstate it another day but could they have the final payment waiting for you in cash that might helpWink.

small claims court is not really a good way to go as even if you win the case they may be ordered to pay £10 a week . I hope you have some luck sorting this out.

thanks guys.appreciate the responses.feel like i have been led on and am fuming but i can not see a happy way round this. court case is the last thing i want to do, waste of time and money for the extra stress. taking wall down will surely lead to more stress with police if not customer? i have a customer who works for fair trade and he advise removing the rubbish left on the job ( pallets and bags which the left over materials were on) and write her a letter clearly stating what i have done and what is owed. i won the job on here. clearly this person knew what she was doing. i think written quotes from now on is the only way forward for me and my new business.

Another thing you can do is send her an OVERDUE payment invoice - with various payment methods on it and crucially the date when payment should have been made.

Often, people respond to a written demand for payment. Especially if you print it on pink paper and place it in an address window envelope (so it looks like a red overdue bill for all to see).

Wink

Hello

send them a letter that if you are not paid within 7 days you will take them to the small claims court

you can do this on line when they receive the summons they have about three weeks to pay or defend it with a written reason why they have not paid. if the workmanship is good they don't have a leg to stand on

But the court requires you to give them a final notice, if they don't respond or defend the claim judgement will go in your favour and all the credit reference agents will be informed it still may not get you your cash...... but after a while you could i think that i am right in saying  put a charge on there house !!!....... ( ask in the legal forum)

Revenge is best served cold !!!

send them a letter telling them that they have 14 days to pay up (legal requirement) in that letter tell them that you will charge them for removing the unpaid item. at the going rate.  brick layers JIB rates are at around 17.50 an hour.  Also tell them that they will be charged fuel and a whole list of claimables.  Give them their time dont send any more texts.  if they do not pay attend when you know they are away at work and start removing the wall.  As removing their wall would not leave their home insecure you have a right to under current law.  Even if they have paid for the bricks and motar.  then charge them full rate for removal.

If the final bill comes to more than £500 then claiming it back in a small claims court can also have this bonus applied.  If the total amount comes to in excess of £500 you can apply for a bankruptcy hearing.  Also if they own their own home which i think they would you can make a charge against the sale of their home.

Try some of these ideas.  In your letter you should realy tell them of your intentions of the above.  Yes they will be furious however they will have sense to pay as all the solicitors fees will land at their feet.

Recomendations.  Frankly i wouldnt want any work from customers who work like that at all.

I have afew people try to get out of paying for new boiler installations but if they own a small business a winding up order does the trick overnight.  Good luck and remember dont give them anything to say harrasment.  Tell them what you are going to do and do it.  if you have a friend with a jcn handy who will come along on the day of removal ensure you record you knocking the door as a last chance.

Do what was suggested, go there with a BIG associate and  start taking the wall down.

The point is if you do take it doen fully she'll have to get it rebuilt, she will realize this and the inconvenience will soon produce thee money. Then charge her to rectify what you already took down.

In my experience if you try to do customers favours it always ends up costing you money.

How true !

in an ideal and just world you should be allowed to return to a job and remove the benefit of your labour when a customer trys to con you

However the law takes a different view if you rock up to someone's property and entire without invitation you are trespassing if they call the police most likely you will be arrested

and if you have caused damage  then you could  be charged with Malicious damage and find yourself in court ! sorry guys but the only way is the law ! go to the small claims court it is a pain but the only way if you want to be paid

Lightweight has a good point, you would be trespassing but in such a case I don't believe any but the most nasty police officerwould arest you for merely removing your property from the site.

You could go down the County court route before you do it and get a court judgement but who wants the hassle. But if you had a judgement order to produce to police tey'd likely come out on your side which would then make the woman see sense and pay up.

There again it's all hassle isn't it? Who needs it?

By the way,  the best place to start warning people about her is the place she originated her enquiry to you.
