Can you legally cancel a mobile phone contract after activation?

A friend of mine was recently talked into a new phone/contract with three. When he received the phone he activated sim card then someone pointed out to him he didn't need a second phone and should just use his main phone for work. He asked to cancel the contract but three told him he couldn't as the sim was used. The cancellation fee would be 400 pound hence it would be cheaper to pay out the contract and not use the phone.

Even though the SIM is used can he legally cancel the contract as its within 7days, and not receive a penalty. Three just tell him he has to pay and they will get debt collectors if he doesn't. Any advice ?

judging from the date of your question and the fact that no one has answered it is rather telling that if there is no money in it for people they are not interested in answering. Sad!

You would usually have a cooling off period of between 7 - 14 days subject how the contract was entered into. Change your mind, fine, pay for the calls made, return it. It should be as simple as that... with some drama from in respect opf cancellation etc.
